Who is Eligible for SSD?
Individuals with disabilities, either permanent or temporary, who will miss more than a year of work are eligible to apply for SSD. The disability can be physical, mental or a combination of both. Examples of these disabilities include cancer, bipolar disorder, multiple sclerosis or schizophrenia.
While the disability need not be permanent, individuals do need to meet a high standard of disability or hardship. We will work with you and your doctors to compile the necessary documentation showing that you meet these stringent requirements.
Social Security Disability Denials
The process of applying for the benefit is lengthy and involves many steps. Most people can complete an initial application without a lawyer by contacting your local Social Security Administration Office. However, representation is needed if you receive a notice that SSD benefits have been denied.
If you have been denied benefits, it is important to take immediate steps to appeal. You generally have only 60 days from the date of denial to file your appeal. The first step in the appeals process is called a Request for Reconsideration. This requires filing several forms and authorizing Social Security access to your medical records. If the first appeal is also denied, we work to arrange a hearing in Atlanta before an administrative law judge who works for the Social Security Administration.
A Time-Consuming Endeavor
The appeals process is lengthy. The Atlanta hearing offices are considered to be one of the most backlogged offices in the country. However, if your appeal is upheld at the hearing level, you will likely be granted payments for back benefits.
