Common Reasons Social Security Disability Claims Are Denied

Denied Benefits? It's More Common Than You'd Think. Call Ellene Welsh for Support Today.

Most people are surprised to learn that a huge percentage of disability claims are denied the first time around, and not because applicants don’t qualify. Many denials are triggered by paperwork mistakes, missing medical evidence, or unclear descriptions and details concerning the qualifying disability.
Common reasons for denial of claims include:

Insufficient medical evidence to show how your condition affects your capability to work

Failure to follow up with medical treatment or doctor recommendations

Determination by the Social Security Administration (SSA) that you can still perform some kind of work

Paperwork errors, missed deadlines, or incomplete forms

Lack of clarity on how your condition limits daily activities and job performance

The frustrating reality is that many SSD applicants who deserve benefits end up stuck in appeals for months (or even years) just because of errors or omissions in the original paperwork. That’s why it helps to have an experienced SSD lawyer who knows how to navigate the system on your side from the beginning.

Why Choose Our Georgia Social Security Disability Lawyer?

Discover What Ellene Welsh Brings to the Table

You’re more than just a case number to us. We treat every client as a valued member of the community deserving of a helping hand during a challenging time. Here’s why so many have chosen our Social Security Disability lawyer in Georgia.

Extensive Experience With Disability Claims

We’ve been handling disability claims in Georgia for years. That means we know the local legal landscape, including the offices, administrative law judges, and SSA procedures inside and out. We’ve walked this path hundreds of times before. We know what medical records to gather, which forms matter most, and how best to present your argument for benefits to the Social Security Administration.

Proven Track Record of Success

We’ve been handling disability claims in Georgia for years. That means we know the local legal landscape, including the offices, administrative law judges, and SSA procedures inside and out. We’ve walked this path hundreds of times before. We know what medical records to gather, which forms matter most, and how best to present your argument for benefits to the Social Security Administration.

Compassionate Representation

We’re not here to judge you. We’re here to help. We understand how hard it is to live with a medical condition that turns your life upside down. Maybe you’re worried about bills, scared of another denial, or just exhausted from being passed around by the system. We get it. That’s why we really listen before we act. You’re not a case number to us. You deserve dignity, respect, and someone in your corner.

We Only Get Paid if You Win Your Case

We believe getting help shouldn’t add more stress to your plate when you’re already dealing with health issues and financial strain. That’s why you don’t pay anything unless we secure your benefits. When we fight and win, our fee is taken from your backpay and not your future monthly benefits. It’s low-risk, straightforward, and fair. When Social Security Disability lawyer Ellene Welsh takes on a client, you can rest assured that you have a partner on your side who’s fully invested in your success, because your win is our win.

What To Do if Your Claim Has Been Denied in Georgia

Navigating Denials Together
Getting a denial letter can feel heartwrenching, but any experienced SSD lawyer will advise you not to panic, and definitely don’t give up. You still have options. Most disability claims are won during the appeals process, not the first round, and it’s crucial to remember that a denial isn’t the end of the road.

The first step to claiming your rightful compensation after an SSD denial is to file a request for reconsideration. At this point, you’re essentially submitting a formal request to the Social Security Administration, asking that they take another look at your claim.

If a request for consideration isn’t successful, SSD applicants may continue to pursue their benefits through a hearing in front of an administrative law judge. This is your chance to present more evidence, clarify your situation, and have someone listen to your side in person.

When it comes to Social Security Disability claims, timing is everything. In Georgia, you only have 60 days to appeal after a denial. Miss that window, and you might have to start the whole process over again.

Our Social Security Disability lawyer in Georgia could step in and handle the appeal from day one. We’ll dig into what went wrong, collect stronger medical records, prepare you for the hearing, and represent you in court if needed. You don’t have to face this alone.

Medical Conditions That May Qualify for Disability

Medical conditions that may qualify you for automatic approval

The SSA has a long list of medical conditions that can qualify someone for Social Security Disability benefits. These include physical, mental, and emotional conditions that can affect your capacity to work. Sometimes a qualifying disability can involve a combination of conditions. What matters most is how the condition limits your ability to work and function daily.

Even if your specific condition isn’t on the SSA’s official list, you might still qualify. As with any disability claim, you’ll be required to show how it impacts your capacity to hold a steady job. That’s where we come in. At the Law Office of Ellene Welsh, our SSD lawyer is proud to help applicants gather the required evidence and present it with a compelling argument for compensation.

Chronic back problems, spinal disorders, or severe joint pain

Autoimmune diseases like lupus or rheumatoid arthritis

Mental health conditions such as depression, anxiety, PTSD, or bipolar disorder

Neurological issues, including multiple sclerosis, epilepsy, or traumatic brain injuries

Serious heart conditions, respiratory illnesses, or cancer

Diabetes complications or kidney disease

When I first got my review denial letter from SSA and had to appeal I was crushed...I contacted several lawyers and no one wanted to take my case. I contacted Ellene Welsh law firm and spoke with Annette and told her about my situation(she spoke with Attorney Welsh) they agreed and took my case. Let me tell you, they are so thorough...they took the time to explain everything to me each step of the way and obtained all medical records, worked endlessly with my SSA hearing officer, and help ease my anxiety. I'm happy to write after a long battle I received a fully favorable decision with no hearing!! If you need a office that will work tirelessly for you then look no further...
Thankyou so much to Attorney Welsh and Annette...

I had tried to get my disability first with a different lawyer and was turned down. When I called thier office to ask about an appeal they said they couldn't help me and was very rude and hung up on me. Found another lawyer who did my appeal was turned down. I called Ellene Welsh and her and her staff were very nice and helpful. Of course it was during the pandemic so we had to do things differently but she helped me and I won my case. Anytime I had a question they were very helpful and nice. If I could just say if you need a great lawyer with a great staff call her. They will fight for you. Love them.

I became a client of Ellene's 3 years ago. When I first met Ellene she took a great deal of time to go over my denied paperwork from Social Security. She explained it was not a quick process and we would be looking at least another year to eighteen months before a hearing. She explained every step! When I had questions Becky and other office staff were always there to walk me through my questions and ease my mind and at times frustrations. Never along this journey did I feel ignored or abandoned. Ellene's staff got all my records together for my hearing and thanks to their hard work we got an immediate decision. It is very rare, I knew it was a good case going in, but Ellene made sure every "I" was dotted and every "T" was crossed. She was excellent in front of the judge and knows what she is doing. It was her 20 plus years experience that makes her so good! I can't thank Ellene and her staff enough for all their time, hard work and dedication in helping me with my case. I highly recommend her to anyone looking for a Social Security Disability Attorney.

FAQs About Georgia Social Security Disability

Common Questions

How Long Does it Take to Get Approved for Disability?

It depends on the circumstances, but most initial decisions take about three to six months. If your application is denied and you have to go through the appeals process, it can take much longer, sometimes up to a year or more.

Can I Work Part-Time While Receiving Disability Benefits?

Yes, but there are limits. The SSA allows you to earn a small amount of money through what they call "substantial gainful activity." As long as your income stays below a certain monthly threshold and your work doesn't suggest you're able to do full-time work, you may still qualify. Our SSD lawyer could help you understand what work is allowed and make sure you stay within the rules.

How Many Times Can I Appeal My SSD Claim in GA?

After you file for an initial reconsideration, you have four more opportunities to appeal your Social Security Disability claim. Your attorney can file an appeal for a denied claim by following the steps below:

1. Reconsideration
2. Hearing Before an Administrative Law Judge
3. Review by the Appeals Council
4. Federal Court Review

Most people don’t need to go through every stage, and many win at the hearing level. You just have to act fast at each step because you only get 60 days to file each appeal.

How Much Does it Cost to Hire a Disability Lawyer in Georgia?

Hiring our SSD Lawyer won’t cost you anything upfront. We only get paid if we win. And even then, our fee is capped by federal law. It typically comes out of your backpay, not your ongoing benefits, so there's no risk to you, and no surprise bills to worry about.

Can I Apply for Both SSD And SSI?

Yes, some people qualify for both. SSD is based on your work history, and SSI (Supplemental Security Income) is based on financial need. If you meet the requirements for both programs, you can apply for both at the same time. We could help you figure out which benefits you qualify for and how to apply properly.
